Welcome to Shape Calendar (under sole trader Samuel Kraft). These Terms of Use ("Terms") govern your use of our workout planning calendar app and services ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
1. Use of Services
- Eligibility: You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that you meet this eligibility requirement.
- Account Registration: You may be required to register for an account to access certain features of our Services. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- Account Security: You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
2. User Conduct
You agree not to engage in any of the following prohibited activities:
- Using the Services for any illegal purpose or in violation of any local, state, national, or international law
- Interfering with or compromising the integrity or security of the Services
- Attempting to gain unauthorized access to the Services or its related systems or networks
- Using the Services to transmit any viruses, malware, or other harmful code
- Uploading or sharing any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
- Uploading or sharing any content that infringes on any intellectual property or other proprietary rights of any party
3. Integration with Third-Party Providers
Our Services may integrate with third-party providers to sync your workout activities. For example, by connecting your Strava account, you authorize us to access and use your data from Strava in accordance with our Privacy Policy. We may add additional third-party integrations in the future.
4. Calendar Sync Feature
Our Services include a feature that allows you to generate a link to import your workout activities into your personal calendar:
- User Responsibility: You are responsible for managing the distribution of this link. Anyone with access to the link can view your workout activities.
- Privacy: Do not share the link with untrusted individuals. If you believe the link has been compromised, you can disable it in your account settings.
5. Subscription Plans
We offer various subscription options to access premium features of our Services:
- Monthly Plan: A recurring subscription billed on a monthly basis. You may cancel at any time, and your access will continue until the end of the current billing period.
- Lifetime Plan: A one-time purchase granting access to premium features for the lifetime of the Service. "Lifetime" refers to the operational lifespan of Shape Calendar as a service, not the lifetime of the user. If the Service is discontinued, substantially transformed into a different product, or acquired by another entity that materially changes its nature, the lifetime access guarantee may no longer apply. We will make reasonable efforts to provide advance notice of any such changes.
6. Fair Use Policy
All subscription plans are subject to a fair use policy designed to ensure equitable access and maintain service quality for all users:
- Rate Limiting: All features, including AI-powered workout generation, are subject to reasonable rate limits. These limits are designed to accommodate normal, personal use of the Services and prevent abuse.
- AI Features: AI-generated content (such as workout suggestions) is rate limited to ensure fair access for all users. Excessive or automated requests may be throttled or blocked.
- Personal Use: Our Services are intended for personal, non-commercial use. You may not use the Services to provide workout planning services to third parties, resell access, or use automated tools to extract data or content.
- Abuse: We reserve the right to suspend or terminate accounts that we reasonably believe are abusing the Services, circumventing rate limits, or violating the spirit of this fair use policy.
7. Dormant Accounts
To maintain service quality and manage infrastructure costs, we have policies in place for inactive accounts:
- Paused Imports (3 months): If you do not sign in to your account for 3 consecutive months, automatic syncing and importing of workouts from connected third-party services (such as Strava, Garmin, or Wahoo) will be paused. Syncing will resume automatically once you sign back in.
- Data Deletion (1 year): If you do not sign in to your account for 1 year, we reserve the right to delete your stored activity data to free up storage resources. We will make reasonable efforts to notify you via email before any data deletion occurs. To prevent data loss, simply sign in to your account periodically.
- Account Preservation: Your account credentials and third-party connections will remain intact even if your data is deleted due to inactivity. You can reconnect and start fresh at any time by signing back in.
8. Intellectual Property
All content and materials included in the Services, such as text, graphics, logos, and software, are the property of Shape or its licensors and are protected by applicable intellectual property laws. You agree not to reproduce, distribute, modify, or create derivative works of any content from the Services without our express written permission.
9. Termination
We may terminate or suspend your access to the Services, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
10. Limitation of Liability
To the fullest extent permitted by law, Shape shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Services.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. You are advised to review these Terms periodically for any changes. Your continued use of the Services after the changes have been posted constitutes your acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles.
